Times Square Porn Monger Sued for Paying Booth-Cleaner Less Than Minimum Wage

An adult DVD and sex toy store, that also showed films in private viewing booths, is being sued by a former employee who claims it failed to pay him minimum wage over a six-year period. The man says he frequently made less than seven dollars an hour, working twelve-hour shifts, up to seven days per week.

Kowrishanker Malaikolundu began working for Blue DVD, Inc. in 2011 as a cashier, bill changer, and video-booth cleaner, according to the complaint. He worked in both Blue DVD locations — in Times Square and Chelsea. He was also employed by Sexy Shakes, Inc., which operated out of the same location, and was owned by the same men as Blue DVD and sold food items, beverages and shakes.

Throughout his employment, Malaikolundu states that he worked twelve-hour shifts, either a night shift (8 p.m. to 8 a.m.) or a day shift (8 a.m. to 8 p.m.).  The number of shifts he worked each week varied over the years from four to seven. 

During the entire time he was working for Blue DVD Malaikolundu received approximately $75 per day, according to the complaint. Thus, for the weeks he worked four shifts, he received $300 and for those he worked seven, he got $525, though that amount rose slightly by the end of his employment to $575. This would mean his wage was often less than seven dollars an hour.

Currently, the minimum wage for smaller operations in New York City like Blue DVD is $10.50 per hour, to rise to $12 in 2018, as part of state legislation designed to raise New York’s minimum wage to $15 an hour by 2020.

Malaikulundu says Blue DVD did not provide him with proper written notices upon hiring, nor at annual intervals, as required by law, regarding details of  payments to him, according to the complaint.

The suit seeks full payment of required minimum wages during the course of his employment, overtime compensation, and spread of hours pay.  It was brought in the Southern District of New York by Naresh Gehi of Ozone Park, New York.

Blue did not return a message requesting comment.
